Garden Suites in Burlington

Burlington calls a garden suite an additional residential unit – detached: a self-contained home inside an accessory building on the same lot as a detached house, semi, street townhouse or rear lane townhouse.

The rules, in plain language

What Burlington allows

Burlington's Zoning By-law 009-2026 (Part 5, Section 5.14) allows up to three additional residential units on urban residential land wherever one detached house, semi, street townhouse or rear lane townhouse is permitted. Up to two of those can be detached, but all detached units must be in one accessory building.

Access

  • Exterior stairs above the first storey can't project into the front, exterior side or required interior side yard.

Check with the city: Burlington's Zoning By-law 009-2026 is new. Confirm it is in force for your property and whether any transition rules apply. These pages don't state parking, servicing, lot coverage, development charges or permit fees for detached units, so check those with Burlington Building and Zoning before you design.
